I met an Indonesian woman (in Indonesia) who had a child by an English guy (not married). He has abandoned her for a Thai girl and is now in England.

I think he should have to pay for the rest of his life for being such a scumbag.

Unfortunately the UK Child Support Agency indicated that they can't do anything for someone outside in the UK (if she were in the UK, he'd be screwed big time), and she should contact the Indonesian courts. Good luck with that......

Any ideas?

that's what I'd figured. When the Child Support woman said to apply for maintenance in Indonesia I stifled a laugh.

At least the kid should be able to get a British passport. But of course she is not allowed in the UK, so there's no way for the kid to come to the UK either.

I'm afraid she has little chance for succes,cause now she has to prove that he is the father and he might not be willing to cooperate.Ofcourse she made the mistake to let him do his thing,but also there is something we call trust.If she has name and more personal info about the guy maybe there is a chance to do something about it. It's just that it appears that he can't be made to pay a penny.....

I'm sure a DNA test could be arranged if there was a child support arrangement at the end of it, but that doesn't seem possible.

The reason is that in the first place the girl is already very wrong (also according to the law) to have sex before getting married, having a baby before being married is big taboe.

So to let that same law forcing the guy to pay her money is already impossible because she is the one that broke the law in the first place..

I wonder if Sidia has the same opinion

The child is indonesian acc. the indonesian law.
Its almost impossible to force the father to recognised " his" child because he is lucky to flew away .
its another story if he is still living in indonesia.
They can " force" him to take his responcibility.
Lucky bastard.

Of course she can try to sue him in England , if she had enough money or friends in England.

Actually they had some kind of wedding ceremony, but no surat nikah.

When I got married it was not really good to get married in Indonesia, so we got married in Thailand instead.

Moslim Wedding ceremony ??? , the so called Kawin Sirih ?
I think its official within the Moslim Law .

Get legal advice , from LBH or IndoMix couple Jakarta .

kawin sirih is niet rechtsgeldig (tidak sah)
je 'trouwt' zonder papieren, eigenlijk enkel om je lokale situatie (samenwonen) sociaal en religieus aanvaardbaar te maken (heb ik zelf wel wat ervaring mee)
als buitenlander blijf je zo zeker totaal buiten schot in geval van eventuele kinderen of zo
die engelsman waar het dus over gaat, hoeft niets te vrezen
jammer voor dat meisje, maar de indonesische wet geeft haar totaal geen bescherming

Marriage in Indonesia

3 possibilities : Faith Law ,(Islam, Christian etc) , State Law
Adat law .
Sometimes the 2 combinations .

First step :
A Moslim wedding(Islam law) have the same value like a wedding between 2 christian people ,blessed bij the church and family-friends.


Second step.
Only its not enough for the state , after the ceremy you must go to the
Capil (Cityhall ?) a.o KUA .

I think the 1st step is official enough to sue the father.
He make promisses to his wife , in the face of God and other people.
